Terms of Service

1. Acceptance

By using PandaCoco (hereinafter "the App"), you accept these Terms of Service and our Privacy Policy. If you do not accept, do not use the App.

2. Service description

PandaCoco is an educational application for learning Mandarin Chinese. The service includes interactive lessons, flashcards, writing exercises, leaderboards, and an AI tutor ("Coco").

3. Account

To use the App, you must create an account with email and password or via Google Sign-In.
You are responsible for the security of your account and the confidentiality of your credentials.
An account is personal and non-transferable. Sharing access with others is not permitted.
You can delete your account at any time from Profile > Settings > Delete Account.

4. Minimum age

The App is accessible to everyone. However, minors under 14 years old require the consent of a parent or legal guardian to register (pursuant to Italian GDPR regulations).

To make purchases, you must be at least 18 years old, or proceed with the consent and under the supervision of a parent or legal guardian.

5. Premium subscription

5.1 Plans and payment

The App offers a free plan with limited features and Premium subscriptions (monthly or annual). Payments are processed by the respective stores: App Store (iOS) or Google Play (Android).

5.2 Automatic renewal

Subscriptions renew automatically at the end of the current period, unless cancelled before the renewal date.

5.3 Cancellation

You can cancel your subscription at any time from Profile > Shop > Manage Subscription. Cancellation takes effect at the end of the already paid period: you will continue to have Premium access until expiration.

5.4 Right of withdrawal (EU)

Pursuant to Directive 2011/83/EU, you have the right to withdraw within 14 days of purchase without having to provide any reason. To exercise the withdrawal, write to canyonLabs@gmail.com indicating your details and the date of purchase. The refund will be issued within 14 days using the same payment method used.

6. AI Tutor (Coco)

Coco is an assistant based on generative artificial intelligence (Anthropic Claude and OpenAI GPT). By using Coco, you agree to the following:

Coco is not a certified teacher. Responses are automatically generated and may contain errors, inaccuracies, or incomplete information.
No guarantee of accuracy. PandaCoco does not guarantee the correctness of Coco's responses. Always verify important information with reliable sources.
Do not share sensitive data. Messages are processed by third-party services (Anthropic, OpenAI). Do not enter sensitive personal data, documents, passwords, or financial information in the chat.
Conversations are not saved on our servers. They are kept in memory only during the session.
Usage limits. The chatbot is subject to a daily message limit. Premium users have access to the chatbot; free users do not.

7. Content and intellectual property

All App content (lessons, exercises, flashcards, graphics, texts) is the property of PandaCoco and protected by copyright laws.
Copying, reproducing, distributing, or creating derivative works from App content without written authorization is not permitted.
User-generated content (username, avatar) remains the property of the user.

8. User conduct

It is not permitted to:

Use the App for illegal or unauthorized purposes.
Attempt to access other users' accounts or data.
Abuse the Coco chatbot to generate offensive, illegal, or content unrelated to Chinese learning.
Use bots, scripts, or automated tools to interact with the App.
Choose offensive, vulgar usernames or those that violate third-party rights.
Manipulate the leaderboard, scores, or gameplay mechanics.

Violation of these rules may result in the suspension or deletion of the account without prior notice.

9. Limitation of liability

The App is provided "as is", without warranties of any kind, express or implied.
PandaCoco does not guarantee that the service will always be available, error-free, or uninterrupted.
PandaCoco is not responsible for any direct, indirect, or consequential damages arising from the use of the App or AI-generated content.
The App is a learning support tool and does not replace certified language courses or qualified teachers.

10. Changes to the service and terms

We reserve the right to modify, suspend, or discontinue any App feature at any time. In case of substantial changes to these Terms, we will inform you via in-app notification or email. Continued use of the service after the change implies acceptance of the new terms.

11. Applicable law and jurisdiction

These Terms are governed by Italian law. For any dispute, the court of the consumer's place of residence has jurisdiction, pursuant to Legislative Decree 206/2005 (Consumer Code).

Alternatively, you can use the European Union's ODR platform for online dispute resolution: ec.europa.eu/consumers/odr.
